1. Who We Are and What These Terms Cover

IELTS by Mercy is the organisation responsible for the services described in these policies. These Terms apply to the Website and the Learning Management System, including related features made available through those sites.

2. The Public Website

The Website provides information about IELTS by Mercy, its training services, learning approach and ways to contact or begin enrolment. Browsing the Website does not by itself create a student enrolment contract or guarantee a place on a course.

3. The Learning Platform

The Learning Management System provides enrolled users with access to IELTS preparation materials and related features, which may include video lessons, modules, mock tests, writing samples, vocabulary guides, band descriptors, resources, progress information and instructor support.

The exact content, course duration, access period and features available to you are those communicated to you at enrolment or displayed for the course you purchase or are assigned.

4. Enrolment and Accounts

Student accounts are created or activated by an authorised instructor or administrator after enrolment. You must provide accurate information and keep your login details confidential.

  • Do not share your account with another person.
  • Do not use another person’s account.
  • Tell us promptly if you suspect unauthorised access.

You are responsible for activity carried out through your account unless you can show that the activity occurred without your fault and you reported the issue promptly.

5. Students Under 18

Where a student is a child or otherwise lacks legal capacity to consent, a parent or legal guardian must be involved as required by applicable law. We may request information needed to verify the parent or guardian’s authority and consent.

6. Fees, Payment and Refunds

Course fees, payment instructions, access periods and any applicable taxes or charges will be communicated before you enrol or pay. The platform does not currently store card or other payment details itself; where an external payment provider is used, that provider’s terms may also apply.

Unless a separate written refund or cancellation policy applies, fees for a course that has already been made available to you are generally non-refundable to the extent permitted by law. This does not remove any refund, cancellation or consumer right that cannot lawfully be excluded.

If payment is overdue or reversed, we may suspend access after giving reasonable notice where practicable.

7. What You May Do

Subject to these Terms and your course access, you may use the platform for your own IELTS preparation and personal learning.

8. What You Must Not Do

  • Share, sell, lend or transfer your login credentials.
  • Copy, reproduce, publish, sell, upload, distribute or commercially exploit course materials without written permission.
  • Screen-record, download or redistribute video or other protected course content where doing so is not expressly authorised.
  • Attempt to access another user’s account, data or restricted administration areas.
  • Use bots, scrapers or automated methods to copy substantial parts of the platform.
  • Interfere with security, bypass access controls or introduce malicious code.
  • Use the platform for unlawful, fraudulent, abusive, threatening or harmful purposes.
  • Impersonate another person or provide knowingly false information.
  • Use instructor or student contact features to harass, threaten or send unlawful material.

9. Course Content and Intellectual Property

The IELTS by Mercy name, branding, website design, platform software, videos, written materials, practice resources and other course content belong to IELTS by Mercy or their respective licensors unless stated otherwise. You receive a limited, personal, non-exclusive, non-transferable permission to use the content for your own learning while you are entitled to access it.

You do not receive ownership of the content. Permission ends when your course access ends or your account is closed, subject to any content you are lawfully entitled to retain.

10. IELTS Trademark and Independence

IELTS is a trademark owned by its respective rights holders, including the British Council, IDP: IELTS Australia and Cambridge Assessment English. IELTS by Mercy is an independent IELTS preparation service. It is not the official IELTS test provider and is not represented as being endorsed by or officially affiliated with those organisations.

11. Learning Results and Band Scores

We provide preparation, teaching and learning resources, but we cannot guarantee a particular IELTS band score, test result, admission outcome, visa outcome or other personal result. Results depend on many factors, including preparation, starting ability, attendance, practice, test-day performance and matters outside our control.

Any figures about students trained, experience, success rates or average results are intended to describe general experience and are not promises of an individual outcome.

12. Instructor Support and Communications

You retain ownership of lawful content you send to us. You give IELTS by Mercy permission to store and use that content only as reasonably necessary to respond to you, provide support, operate the Learning Management System, maintain records, investigate complaints, or comply with the law.

You may contact an instructor or administrator through available platform features. Messages should be relevant to your course and respectful. We may retain messages as necessary to provide support, maintain records, investigate complaints or comply with law.

13. Third-Party Services and Video Streaming

Some course videos are streamed through Google Drive. Availability of a third-party service can be affected by outages, changes or restrictions outside our control. Third-party services may also have their own terms and privacy policies.

14. Platform Availability

We aim to keep the platform available and useful, but we do not promise that it will be available every minute or free from interruptions, errors or maintenance. We may temporarily restrict access for maintenance, security, upgrades or circumstances beyond our reasonable control.

15. Suspension or Termination

We may suspend or close an account where we reasonably believe that you have seriously or repeatedly breached these Terms, misused the platform, compromised security, engaged in fraud, failed to pay amounts due, or where suspension is required by law.

Where reasonably practicable, we will explain the reason and provide an opportunity to resolve the issue. Immediate suspension may be necessary where there is a security, fraud, legal or serious misconduct risk.

Closing an account does not remove rights or obligations that by their nature should continue, including intellectual-property rights, confidentiality, payment obligations, dispute provisions and liability provisions.

16. Privacy and Cookies

Our Privacy Policy explains how personal information is handled. Our Cookie Policy explains cookies and similar technologies. Both form part of these Terms.

17. Disclaimers

To the fullest extent permitted by law, the websites and platform are provided on an ‘as available’ basis. We do not promise that every page, video, resource, third-party service or feature will always be uninterrupted, error-free or suitable for every purpose.

Nothing in these Terms excludes a legal warranty, consumer right or liability that Nigerian law does not allow us to exclude.

18. Limitation of Liability

If your unlawful use of the Website or Learning Management System, or your serious breach of these Terms, causes a third-party claim or reasonable loss to IELTS by Mercy, you agree to cooperate with us and, to the extent permitted by law, cover the reasonable losses directly resulting from that breach.

Claims about years of experience, numbers of students, success rates or average band scores are intended to describe general experience and are not guarantees of an individual result.

To the extent permitted by Nigerian law, we will not be liable for indirect or consequential losses such as loss of opportunity, anticipated profits or other knock-on losses arising from use of the sites or platform.

Nothing in these Terms limits liability that cannot lawfully be limited, including liability for fraud or for death or personal injury caused by negligence where the law prevents such limitation.

19. Events Outside Our Reasonable Control

We are not responsible for delay or failure caused by events outside our reasonable control, such as widespread internet or power outages, major cyber incidents, failures of third-party hosting or video services, government action, natural disasters or similar events.

20. Complaints and Dispute Resolution

Submitting a contact form, email or phone enquiry does not by itself create a course contract or guarantee a response within a particular time.

Where a booking or session feature is introduced, the applicable booking, payment, rescheduling and cancellation terms will be provided before the booking is completed.

If the matter cannot be resolved informally, these Terms are governed by the laws of the Federal Republic of Nigeria. Any court proceedings will be brought before a court of competent jurisdiction in Nigeria, subject to any mandatory consumer or other jurisdictional right that applies to you.

21. Changes to These Terms

We may update these Terms when the services, law or platform changes. If a change is material, we will provide reasonable notice where required. The updated Terms will state the latest revision date. Your continued use of the relevant service after the effective date of a change will constitute acceptance only to the extent permitted by law.

22. If One Part Is Invalid

If a court or regulator finds part of these Terms invalid or unenforceable, that part will be interpreted or adjusted to the minimum extent necessary, and the remaining provisions will continue to apply.

23. Entire Agreement and Assignment

These Terms, together with the Privacy Policy, Cookie Policy and any specific course or payment terms provided to you, form the agreement governing your use of the relevant service. You may not transfer your account or obligations to another person without our written permission. We may transfer our rights and obligations as part of a lawful business restructuring, merger or sale, subject to applicable law.
